1. Acceptance of Terms
1.1. By accessing or using the Aroviah website (aroviah.com) ("Website"), creating an account, submitting a medical inquiry, or engaging Aroviah's services in any form (collectively, the "Services"), you ("you," "User," or "Patient") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"), as well as our Privacy Policy, which is incorporated into these Terms by reference.
1.2. If you do not agree to these Terms in their entirety, you must not access or use the Website or Services. Your continued use of the Website or Services following any posted update to these Terms constitutes your acceptance of the revised Terms.
1.3. If you are using the Website or Services on behalf of another person — for example, as a family member, caregiver, or authorized representative arranging treatment for a patient — you represent and warrant that you have the authority to bind that person to these Terms, and that you will ensure that person is made aware of, and agrees to, these Terms.
1.4. These Terms apply equally to casual visitors browsing the Website, registered account holders, and patients actively engaged in an Aroviah-coordinated treatment journey, except where a provision expressly states otherwise.
2. About Aroviah
2.1. Aroviah is a Medical Value Travel (MVT) facilitator operated under Curabridge LLP ("Aroviah," "we," "us," or "our"). Aroviah connects international patients with independent, third-party hospitals, specialists, and healthcare providers in India, and coordinates related services including medical visa guidance, travel arrangements, accommodation, on-ground support, and post-treatment follow-up.
2.2. Aroviah is not a hospital, clinic, medical practice, insurer, or healthcare provider. Aroviah does not employ physicians, nurses, or clinical staff, does not provide medical advice, diagnosis, or treatment, and does not perform, supervise, or participate in any medical procedure. All clinical care is provided solely by independent, third-party hospitals and licensed medical professionals ("Partner Hospitals"), who alone are responsible for the medical care they deliver, the clinical judgments they make, and the outcomes that result.
2.3. Aroviah's role can be summarized as that of a coordination and trust layer between the international patient and India's healthcare ecosystem — managing communication, logistics, documentation, and continuity of support so that the patient does not have to navigate an unfamiliar system alone. Aroviah's role does not extend to, and these Terms should not be interpreted as extending Aroviah's role to, the practice of medicine in any form.
2.4. Aroviah's registered business operates as a venture of Curabridge LLP. References in these Terms to "Aroviah" include Curabridge LLP where the context requires.
3. Definitions
For the purposes of these Terms:
- "Partner Hospital" means any hospital, clinic, diagnostic center, or healthcare provider in India with which Aroviah has a coordination or referral relationship.
- "Referral Partner" means any travel agency, insurance agency, community contact, or other third party that refers a Patient to Aroviah.
- "Service Fee" means the fee charged by Aroviah for its coordination services, as described in Section 8.
- "Treatment Package" means the combined cost of medical treatment, travel, accommodation, and related services associated with a specific Patient's engagement.
- "Medical Visa" or "M-Visa" and "Medical Attendant Visa" or "MX-Visa" refer to the visa categories issued by the Government of India for the purposes described in Section 10.
- "Attendant" means a family member, caregiver, or companion accompanying a Patient during their treatment journey.
4. Eligibility
4.1. To use Aroviah's Services, you must:
- Be at least 18 years of age, or be represented by a parent, legal guardian, or authorized representative if you are a minor or otherwise unable to contract on your own behalf;
- Have the legal capacity to enter into a binding agreement under the laws of your country of residence and of India;
- Provide accurate, current, and complete information when creating an account or submitting a medical inquiry;
- Use the Website and Services only for lawful purposes and in a manner consistent with these Terms; and
- Not be barred from receiving the Services under any applicable law, including sanctions or export control regimes that may apply to your country of residence.
4.2. Aroviah reserves the right, at its sole discretion, to decline to provide Services to any individual or on behalf of any individual, including where Aroviah reasonably believes the request falls outside the scope of the Services it is able to responsibly coordinate.
4.3. Where a Patient is a minor, Aroviah will require the explicit written consent of a parent or legal guardian before coordinating any aspect of the Services, and all communications will be directed to that parent or guardian.
5. Account Registration
5.1. To access certain features of our Website, you may be required to create an account by providing information such as your name, contact details, and relevant medical or travel information.
5.2. You are responsible for maintaining the confidentiality of your account credentials, including your password, and for restricting access to your device and account. You are responsible for all activities that occur under your account, whether or not you authorized them, except where such activity results from Aroviah's own negligence or breach of these Terms.
5.3. You agree to notify Aroviah immediately at support@aroviah.com of any unauthorized use of your account, any suspected breach of security, or any loss or theft of your account credentials.
5.4. Aroviah reserves the right to suspend or terminate accounts that provide false or misleading information, violate these Terms, remain inactive for an extended period, or are used for fraudulent, abusive, or unlawful purposes.
5.5. You may request the deactivation of your account at any time by contacting support@aroviah.com, subject to Aroviah's obligation to retain certain records as required by law or as necessary to complete an in-progress treatment coordination.
6. Nature of Our Services
6.1. Depending on your specific engagement, Aroviah's Services may include:
- Reviewing medical information, reports, and diagnostic records you provide, and coordinating specialist consultations and second opinions with Partner Hospitals;
- Facilitating communication between you and Partner Hospitals regarding treatment options, expected timelines, and cost estimates;
- Presenting a consolidated, itemized Treatment Package cost, inclusive of Aroviah's Service Fee, prior to booking confirmation;
- Providing guidance on Medical Visa and Medical Attendant Visa applications, including coordination of the Hospital Invitation Letter with the relevant Partner Hospital;
- Coordinating travel arrangements, including flights, accommodation, airport transfers, and local transportation in India;
- Providing a dedicated on-ground patient coordinator during your stay in India, including interpreter support where needed;
- Coordinating discharge planning, return travel, and post-treatment follow-up, including scheduling of follow-up teleconsultations with the treating specialist.
6.2. Aroviah acts solely as a facilitator and coordinator of the services described above. All medical evaluations, diagnoses, treatment plans, procedures, prescriptions, and clinical outcomes are determined and delivered exclusively by Partner Hospitals and their medical staff, who exercise independent clinical judgment in accordance with their own professional and legal obligations. Aroviah has no authority over, does not supervise, and assumes no responsibility for, clinical decisions made by Partner Hospitals.
6.3. The specific scope of Services provided to you will be confirmed in writing (including by email) at the time you engage Aroviah, and may vary based on your medical needs, destination hospital, and personal preferences. Nothing in this Section 6 obligates Aroviah to provide any Service not specifically confirmed in writing for your engagement.
6.4. Aroviah does not guarantee the availability of any specific hospital, specialist, appointment date, or treatment slot, all of which remain subject to the Partner Hospital's own scheduling and capacity.
7. Medical Disclaimer
7.1. No medical advice. Nothing on the Website, in any Aroviah marketing material, or communicated by Aroviah staff constitutes medical advice, diagnosis, or treatment recommendation. Any general health or destination information provided is for informational purposes only and must not be relied upon as a substitute for professional medical consultation with a qualified physician.
7.2. No guarantee of outcomes. Aroviah makes no representation or warranty, express or implied, regarding the outcome, success, safety, or result of any medical treatment, procedure, or consultation coordinated through our Services. Medical treatment carries inherent risks — including the risk of complications, adverse reactions, and, in rare cases, death — that cannot be eliminated or guaranteed against by Aroviah or by any Partner Hospital, however experienced.
7.3. Independent medical judgment prevails. Any cost estimate, treatment timeline, or recommendation communicated by Aroviah prior to your arrival in India is based on information and reports provided by you and reviewed remotely by the relevant Partner Hospital. Such estimates are preliminary and subject to change following in-person medical evaluation, additional diagnostic testing, or the identification of complicating factors. Final diagnosis, treatment planning, and pricing are determined solely by the treating Partner Hospital, and Aroviah is not liable for any variance between preliminary estimates and final clinical findings.
7.4. Your responsibility to disclose. You are responsible for providing complete, accurate, and current medical history, records, and information to Aroviah and to the Partner Hospital. Aroviah is not responsible for any consequence — clinical, financial, or otherwise — arising from incomplete, inaccurate, outdated, or withheld medical information on your part.
7.5. Second opinions and consent. You are encouraged to seek independent medical advice and, where relevant, a second opinion before committing to any treatment coordinated through Aroviah. Nothing in these Terms restricts your right to decline a proposed treatment at any stage prior to the procedure itself, subject to the cancellation terms in Section 9.
7.6. Emergency care. Aroviah's Services are not designed for medical emergencies. If you are experiencing a medical emergency, you should contact local emergency services immediately rather than relying on Aroviah's coordination services.
8. Fees and Payment
8.1. Aroviah Service Fee. Aroviah charges a Service Fee, generally ranging from 10% to 15% of your total Treatment Package cost, in exchange for the coordination Services described in Section 6. The applicable percentage for your specific engagement depends on factors including case complexity, length of engagement, and the scope of coordination required, and will be disclosed to you as a separate, itemized line item before you confirm any booking.
8.2. Treatment costs. Costs for medical treatment itself are set independently by the relevant Partner Hospital and are separate from, and not controlled by, Aroviah's Service Fee. Aroviah is not responsible for any increase in treatment cost arising from a change in diagnosis, treatment complexity, length of hospital stay, or complications identified after in-person medical evaluation.
8.3. Third-party costs. Costs for flights, accommodation, ground transportation, visa fees, interpreter services, and other third-party services are payable to, or on behalf of, the relevant third-party provider, and may be subject to that provider's own separate terms, cancellation policies, and additional fees.
8.4. Payment terms. Specific payment terms, accepted payment methods, currency of payment, and any deposit or advance payment requirements will be communicated to you in writing before you confirm a booking. Aroviah may require partial or full payment of its Service Fee and/or estimated Treatment Package cost in advance of coordinating certain Services, such as visa processing or travel bookings, given the upfront costs and effort involved.
8.5. Currency and exchange rates. Where costs are presented to you in a currency other than the currency in which you will ultimately make payment, any exchange rate shown is indicative only. The actual amount payable may vary based on exchange rates applicable at the time payment is processed, and Aroviah is not responsible for currency fluctuations between the time a quote is provided and the time payment is made.
8.6. Taxes. Any applicable taxes, duties, or government levies are the responsibility of the Patient unless otherwise stated in writing, and may be added to the amounts described above.
8.7. Late or failed payments. Aroviah reserves the right to pause or delay coordination of Services, including visa processing and travel bookings, in the event of late, failed, or disputed payment, and is not liable for any resulting delay to your treatment timeline.
9. Cancellations and Refunds
9.1. Cancellation and refund terms differ depending on the stage of your engagement — pre-consultation inquiry, post-booking confirmation, pre-travel, or post-arrival in India — and the specific terms applicable to your engagement will be set out in writing at the time of booking.
9.2. Aroviah's Service Fee may be partially or fully non-refundable once coordination work has commenced — including but not limited to visa document preparation, hospital scheduling, or travel booking — as such work involves real costs, third-party commitments, and effort already incurred on your behalf, regardless of whether you subsequently decide not to proceed.
9.3. Refunds for treatment costs, visa fees, flights, and accommodation are subject to the separate cancellation policies of the relevant Partner Hospital, government authority, airline, or accommodation provider, none of which are within Aroviah's control, and Aroviah does not guarantee any specific refund outcome from these third parties.
9.4. Government visa fees are generally non-refundable regardless of the outcome of a visa application, consistent with Government of India policy, and Aroviah is not able to obtain a refund of such fees on your behalf.
9.5. In the event that a Partner Hospital is unable to provide the confirmed treatment (for example, due to a change in specialist availability), Aroviah will make reasonable efforts to identify a suitable alternative Partner Hospital or specialist, or, where no suitable alternative is available, will work with you regarding an appropriate refund of amounts paid for services not rendered.
9.6. Refund requests should be submitted in writing to support@aroviah.com, and Aroviah will endeavor to acknowledge such requests within a reasonable period and to process any approved refund within a reasonable timeframe thereafter.
10. Medical Visa and Travel Documentation
10.1. Aroviah provides guidance, document coordination, and administrative support for Medical Visa and Medical Attendant Visa applications but does not control, influence, or guarantee the outcome of any visa application, which is determined solely by the Government of India or the relevant Indian diplomatic mission.
10.2. You are responsible for providing accurate, complete, and timely documentation required for your visa application, including a valid passport meeting the Government of India's validity requirements, passport-size photographs, and medical documentation from your local physician where required. Aroviah is not liable for visa delays, rejections, or additional requirements arising from incomplete or inaccurate documentation on your part, changes in immigration policy, or discretionary decisions made by government authorities.
10.3. You are responsible for ensuring your own passport, and the passports of any accompanying Attendants, meet the validity, blank-page, and other requirements applicable at the time of application and at the time of travel.
10.4. Where your nationality requires an in-person or biometric visa application process (as is currently the case, for example, for Bangladeshi and Iraqi nationals, and for Yemeni nationals applying via Jordan or Oman), you acknowledge that this process will take additional time and may require travel to a specific city or country to complete the application, and that Aroviah's role is limited to coordination and guidance rather than control over this process.
10.5. Aroviah recommends that you do not finalize non-refundable travel arrangements until your visa has been approved, and Aroviah is not liable for any loss arising from travel arrangements made in anticipation of a visa that is subsequently delayed or declined.
11. Third-Party Services
11.1. Aroviah coordinates with a range of independent third parties in the course of providing the Services, including but not limited to Partner Hospitals, airlines, hotels and accommodation providers, ground transportation providers, interpreters, and Referral Partners such as travel agencies, insurance agencies, and community contacts.
11.2. These third parties are independent contractors and are not employees, agents, or legal representatives of Aroviah, and their actions do not bind Aroviah beyond what is expressly stated in these Terms. Aroviah is not liable for the acts, omissions, quality of service, negligence, insolvency, or any loss or damage caused by any third-party provider, except to the extent such loss arises from Aroviah's own failure to exercise reasonable care in selecting or coordinating with that provider.
11.3. Your engagement with any third-party provider — for example, admission to a Partner Hospital, or a booking with an airline or hotel — may be subject to that provider's own separate terms and conditions, informed consent forms, privacy policies, and cancellation policies, which you are responsible for reviewing and agreeing to independently. Aroviah's role is to facilitate the introduction and coordination, not to act as guarantor of any third party's obligations to you.
11.4. Where Aroviah receives a referral commission or fee from a Referral Partner or Partner Hospital in connection with your engagement, this does not alter the price you pay, and is disclosed here for transparency: Aroviah's business model includes such commissions as one of several revenue sources, separate from the Service Fee charged directly to you.
12. User Conduct
You agree not to:
- Provide false, misleading, incomplete, or fraudulent information to Aroviah, a Partner Hospital, or any third-party provider coordinated through the Services;
- Use the Website or Services for any unlawful purpose or in violation of any applicable law or regulation;
- Attempt to gain unauthorized access to any part of the Website, other user accounts, or Aroviah's internal systems or data;
- Interfere with, disrupt, or place an unreasonable load on the operation of the Website or Aroviah's systems, including through the use of automated tools, bots, or scrapers;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity; or
- Use content, data, or materials from the Website for any commercial purpose without Aroviah's prior written consent.
Violation of this Section 12 may result in immediate suspension or termination of your account and access to the Services, in addition to any other remedies available to Aroviah under law.
13. Intellectual Property
13.1. All content on the Aroviah Website, including but not limited to text, graphics, logos, icons, images, the "Care Beyond Borders" mark, the Aroviah name and logo, and the overall look and feel of the Website, is the property of Curabridge LLP / Aroviah or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.
13.2. You may view, download, and print content from the Website solely for your own personal, non-commercial use in connection with evaluating or using the Services. You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on the Website for any other purpose without Aroviah's prior written permission.
13.3. Any feedback, suggestions, or ideas you provide to Aroviah regarding the Website or Services may be used by Aroviah without restriction or compensation to you.
14. Privacy and Data Protection
14.1. Aroviah collects and processes personal and medical information as described in our separate Privacy Policy, in order to provide the Services, including sharing necessary information with Partner Hospitals, Referral Partners, and relevant government authorities (for example, for visa processing purposes) strictly to the extent required to coordinate your care and travel.
14.2. By using the Services, you consent to the collection, use, storage, and necessary sharing of your personal and medical information as described in our Privacy Policy, which forms part of these Terms.
14.3. Aroviah takes reasonable technical and organizational measures to protect your personal and medical information but cannot guarantee absolute security of information transmitted over the internet, stored electronically, or shared with third parties necessary to deliver the Services.
14.4. Given the sensitivity of medical information involved in Aroviah's Services, this section should be expanded into a full, standalone Privacy Policy addressing applicable data protection law — including India's Digital Personal Data Protection Act and any relevant data protection law in your home country — and reviewed by legal counsel before publication.
15. Limitation of Liability
15.1. To the maximum extent permitted by applicable law, Aroviah's total aggregate liability arising out of or related to these Terms, the Website, or your use of the Services — whether in contract, tort (including negligence), or otherwise — shall not exceed the total Service Fee paid by you to Aroviah for the specific engagement giving rise to the claim.
15.2. To the maximum extent permitted by applicable law, Aroviah shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of income, loss of opportunity, loss of data, or emotional distress, arising from your use of the Website or Services, even if Aroviah has been advised of the possibility of such damages.
15.3. Nothing in these Terms is intended to exclude or limit liability for death or personal injury caused by Aroviah's own proven negligence, fraud, or any other liability that cannot be excluded or limited as a matter of applicable law.
15.4. Aroviah is not liable for any act, omission, error, negligence, or malpractice of any Partner Hospital, physician, nurse, or other medical professional, nor for any airline, accommodation provider, ground transportation provider, or other independent third party engaged in connection with your treatment journey. Any claim relating to clinical care should be directed to the treating Partner Hospital directly, and Aroviah will provide reasonable assistance in facilitating that communication.
16. Indemnification
You agree to indemnify, defend, and hold harmless Aroviah, Curabridge LLP, and their respective directors, officers, employees, and agents from and against any claim, liability, damage, loss, cost, or expense (including reasonable legal fees) arising out of or relating to: (a) your breach of these Terms; (b) your misuse of the Website or Services; (c) any information you provide being false, misleading, or incomplete; or (d) your violation of any applicable law or the rights of any third party.
17. Disclaimers
17.1. The Website and Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement.
17.2. Aroviah does not warrant that the Website will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected, or that the Website is free of viruses or other harmful components.
17.3. Aroviah does not warrant the accuracy, completeness, or currency of any information on the Website, including cost estimates, market data, or general health information, all of which are provided for general informational purposes and subject to change.
18. Force Majeure
Aroviah shall not be liable for any delay or failure to perform its obligations under these Terms resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, epidemic or pandemic, government action, changes in immigration or visa policy, flight cancellations, or failures of third-party infrastructure or service providers.
19. Governing Law and Dispute Resolution
19.1. These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
19.2. Any dispute, controversy, or claim arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall first be addressed through good-faith negotiation between the parties.
19.3. [This section requires input from legal counsel given the cross-border nature of Aroviah's patients. Specify here the courts of a particular jurisdiction and/or an arbitration mechanism — for example: "Any dispute not resolved through negotiation within 30 days shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, seated in [city], India, conducted in the English language, before a sole arbitrator." Consider also whether a separate, simplified dispute-resolution path is appropriate for lower-value consumer disputes, consistent with the consumer protection laws of the jurisdictions your patients come from.]
20. Changes to These Terms
Aroviah may update these Terms from time to time to reflect changes in our Services, legal or regulatory requirements, or business practices. The "Last Updated" date at the top of this page will reflect the most recent revision. Continued use of the Website or Services after changes are posted constitutes your acceptance of the revised Terms. For material changes that significantly affect your rights or obligations, Aroviah will make reasonable efforts to notify registered users directly, including by email.
21. Termination
21.1. Aroviah reserves the right to suspend or terminate your access to the Website or Services, with or without prior notice, if you violate these Terms, provide false information, or engage in conduct that Aroviah reasonably believes is harmful to Aroviah, its Partner Hospitals, Referral Partners, or other users.
21.2. You may terminate your engagement with Aroviah at any time by written notice to support@aroviah.com, subject to the cancellation and refund terms described in Section 9.
21.3. Sections 7, 14, 15, 16, 17, and 19 of these Terms shall survive any termination of your account or engagement with Aroviah.
22. Communications and Notices
22.1. Aroviah may communicate with you by email, telephone, WhatsApp, or other messaging channels using the contact details you provide, for purposes related to your engagement, including treatment coordination, visa processing updates, and payment matters.
22.2. Any formal notice required under these Terms should be sent in writing to the contact details provided in Section 27, and will be deemed received on confirmation of delivery.
23. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect.
24. Waiver
No failure or delay by Aroviah in exercising any right under these Terms shall operate as a waiver of that right, nor shall any single or partial exercise of a right preclude any other or further exercise of that right or any other right.
25. Assignment
You may not assign or transfer your rights or obligations under these Terms without Aroviah's prior written consent. Aroviah may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, or sale of assets.
26. Entire Agreement
These Terms, together with our Privacy Policy and any specific service agreement or written confirmation provided to you at the time of booking, constitute the entire agreement between you and Aroviah regarding your use of the Website and Services, and supersede any prior agreements, representations, or understandings, whether written or oral.
